jay lenoJay Leno is in trouble with the WGA. When he returned to late night TV on Wednesday, he told his audience that he wrote the jokes for his monologue and that he wasn’t relying on “scabs” to do his writing. It was a proud proclamation on his part, but it turns out that he was still violating the rules of the WGA strike. As a member of the WGA, he’s not granted to write. The WGA has met with Leno and let him know he broke the rules, and now the guild is trying to determine whether Leno needs to be punished.

Other late night hosts like Conan O’Brien and Jimmy Kimmel returned without writers and obviously without any sort of scripts. Conan spent a good part of last week spinning his wedding ring on his desk. David Letterman and Craig Ferguson also returned last week, but they’ve writers because Worldwide Pants, which produces both shows, came to an agreement with the WGA.

Magnum P.I. is just one of the classic TV intros you'll find at Net Notables.Do you’ve a few minutes? How about 310 of them? You’ll need that many to watch all 310 (as of this writing) classic, and not so classic, Television show intros listed over at Net Notables.

Originally, the list only contained 101 intros from shows that aired from 1989 and below. But, as commenters continued to ask where their favorite intro was, more and more links were added. Most of them link to videos on YouTube, which means the five hours and 10 minutes you need to view all of the listed items increases exponentially. To give you an example, after you watch the Magnum P.I.introduction that everyone remembers you can also view the first, more jazzy version of the theme.

satanlawyer.jpgOver the last several decades we’ve been treated to an extensive collection of corporate scandals and various cases of fraud, some of the perpetrators walked, but recently more and more of them are ending up doing time and being stripped of much of their wealth.

With each incident, I find myself asking the same question—what about the lawyers?

Not just why didn’t they act to prevent whatever was done, but why do they seem to have no accountability in the aftermath?

But I’m wondering if that’s changing.

Refco Inc.’s former lawyer Joseph Collins was indicted by a federal jury for allegedly helping the futures brokerage hide bad debts from investors, in an uncommon prosecution of an outside counsel in a corporate fraud case.

Collins, a partner in Mayer Brown LLP’s Chicago office, allegedly drafted documents for transactions that hid loans and public filings Refco used in attracting $2.4 billion from banks and investors before the company went bankrupt in 2005, according to a federal indictment unsealed in New York today.

Prosecutors took the rare step of targeting an outside lawyer because Collins played such a “vital” part in the scheme, U.S. Attorney Michael Garcia told journalists today…

“Collins was in a perfect position to protect investors from being harmed, but chose instead to perpetuate the deception by actively assisting Refco’s fraud,” stated Scott Friestad, an associate director of SEC enforcement who oversaw its probe.

For a great discussion of this check out Why Do Lawyers Acquiesce In Their Clients’ Misconduct?Part I, Part II, Part III, by Sung Hui Kim.

What responsibility do you think lawyers bear in past and present scandals?
